General repair and sales conditions
of the after-sales service
Repairs carried out and spare parts or accessories sold by a public limited company incorporated under Luxembourg law, Auchan Luxembourg SA, established and having its registered office at L-2721 Luxembourg, rue Alphonse Weicker, 5, registered in the Luxembourg Trade and Companies Register under the number B 45 515 (“Auchan“) as part of the after-sales service (ASS) are subject to these general conditions.
1. Repairs
The repaired equipment, as referred to in the repair sheet, will be returned to its owner or to any person in possession of the original of this document. It must be recovered within a maximum period of two (2) months from the date of availability of the repaired equipment. After this period, any unclaimed device or, if applicable, any device for which the repair price has not been paid may be destroyed without further notice or notification.
Unless legal or commercial guarantees apply, repair quotes are chargeable according to the displayed price and their payment is due when the device is dropped off. The cost of the estimate is deductible from the price of the repair if the estimate is accepted by the customer or remains acquired by Auchan otherwise. Exceptionally, in the event of a fault related to improper use of the device, the cost of the estimate, including the cost of returning the device, will remain the responsibility of the customer even if he accepts the estimate.
All repairs not covered by legal or commercial guarantees are payable in cash when the device is taken back.They are guaranteed for three (3) months (same parts, same breakdowns), subject to the cases of exclusions referred to in article 3.
2. Spare parts
Any order for spare parts will be made after payment of a deposit of 50% of the price of the part.
Spare parts (chargers, batteries, cells, etc.) are guaranteed for three (3) months, subject to the cases of exclusions referred to in article 3. They must be recovered within a maximum period of two (2) months. from the date of their availability. After this period, any unclaimed device or, if applicable, for which the repair price has not been paid may be destroyed without further notice or notification.
3. Responsibility
Auchan’s responsibility for the loss or deterioration of accessories removed at the same time as the device to be repaired will only be incurred if they are duly mentioned on the repair sheet.
Auchan can in no way be held responsible for the loss of data or files during the intervention or repair. It is the customer’s responsibility to make regular data and software backups.
4. Disclaimer of warranty
The warranty does not cover:
- bumps, breakage, scratches, oxidation or the presence of foreign objects.
- external causes of failure such as lime for steam generators, coffee machines, lightning, liquid infiltration.
- the replacement of consumable parts: belts, light bulbs, batteries, batteries, grids and shaving or cutting knives, fuses, ink cartridges, etc. unless these are themselves the subject of a specific defect at the time of sale.
- damage of external origin linked to a disaster.
- damage resulting from the use of energy, use or installation not in accordance with the manufacturer’s services.
- damage resulting from a program modification, software defect or update, addition of peripherals or use of software acquired by illegal means.
- damage resulting from professional or collective use.
- the content of the devices (food, dishes, clothing, files, files, films, recording media, batteries, various “consumables” …) as well as their accessories (cables, hose, ink …).
- damage occurring during the installation or assembly of the guaranteed device or involving the liability of a third party.
- external parts: varnish, enamel, lacquer, paint, scratches, chips or imprints, in the casing of the device or in its accessories that the buyer could not reasonably ignore upon receipt.
- one use, commercial, collective, industrial or professional.
5. Personal data
Auchan undertakes to process the personal data of Customers in accordance with the legislation in force applicable to the processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (hereinafter “GDPR“).
In accordance with the GDPR, each customer has the right to oppose, access, rectify and delete personal data concerning him, which he can exercise by writing to Auchan Luxembourg SA, Service Clients, 5 Rue Alphonse Weicker, L- 2721 Luxembourg.

6. Applicable law, mediation and competent jurisdiction
These general conditions are subject to Luxembourg law. Without prejudice to the mandatory provisions of consumer law, any dispute relating to the interpretation or execution of these general conditions and of the after-sales service may be submitted to mediation. The most diligent party contacts the other party by registered letter with acknowledgment of receipt and proposes the name of a mediator, to be chosen if necessary from the website accessible at the following address: http://www.europe-consommateurs.eu.
Subject to the applicable mandatory legal provisions, and in the absence of mediation, any dispute relating to the interpretation or execution of these general conditions and of the after-sales service is subject to the exclusive jurisdiction of the competent courts of Luxembourg-city.
