of the Auchan Card

1. Preambule

In its vocation to be closer and closer to its customers, Auchan Luxembourg offers its customers a loyalty card giving them access to a number of advantages in Auchan stores located in Luxembourg in exchange for the delivery by the member, a membership form, duly completed. This card is only available to individuals.

2. Auchan loyalty programme membership

The Auchan loyalty programme is open to any individual, consumer, and aged 18 years or older. The Auchan card is available free of charge within the limit of an Auchan account per customer (same name, same address). The card is issued and activated immediately at your store on the day of the request.

It is possible to join this program either directly online from the website www.auchan.lu or at an Auchan Luxembourg sales outlet by filling out the membership form on the terminals available at the reception and at the Service Area. No registration for this program by mail or telephone will be considered.

Members authorize all audits concerning their identity and home by Auchan, although Auchan is under no obligation to carry out a systematic verification of all the registration forms.

With this card, Auchan Luxembourg will give the member 2 key cards (mini-cards). Members owning several cards in the same household must indicate this at the following address: Auchan Luxembourg – 5 rue Alphonse Weicker – L2721 Luxembourg.

Any change of address, name or any indication that may be necessary under this programme must be notified to Auchan as soon as possible at the reception of your store or by writing to the following address: Auchan Luxembourg – 5 rue Alphonse Weicker- L2721 Luxembourg, or by going directly to the website www.auchan.lu.

3. Processing of personal data

Auchan Luxembourg undertakes to process customers’ personal data in accordance with the legislation in force applicable to the processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 relating to the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC and the Law of 1 August 2018 organizing the National Commission for Protection data and implementation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data , and repealing Directive 95/46 / EC (general data protection regulation), amending the Labor Code and the amended law of March 25, 2015 establishing the treatment regime ts and the conditions and modalities of advancement of civil servants.

4. Benefits of the programme

The Auchan loyalty card is not a means of payment. It allows you on presentation at checkout:

  • to accumulate on your Auchan loyalty account, euros when you buy at a point of sale (excluding sale in the gallery)
  • to obtain vouchers on your future purchases.

Euros credited to the Auchan account can be earned as follows:

  • shelves, advertisements or information contained in the product sheet posted on the site or on the mobile applications relaying the Auchan loyalty programme make it possible both to locate easily the products concerned by the promotional offer and to inform the owner of the loyalty card about a number of euros granted in case of purchase of the product concerned.
  • while being at checkout on presentation of the loyalty card the member accumulates euros, which can partially or globally be used on his future purchases from his next purchases.

The Auchan account is the sum of all the euros that the holder of the Auchan loyalty card has accumulated at the point of sale by purchasing products marked on the shelf and presentation of his card at the time of his check-in, possibly minus the euro he could have already spent or will be withdrawn in case of cancellation of an order or any attempt of fraud.

To know the balance of his Auchan Account, the holder of the Auchan loyalty card is invited to connect to his loyalty section present on the website www.auchan.lu or to refer to the bottom of his receipt. The statement of Auchan Account is systematically printed on the receipt of the holders of the Auchan loyalty card in the form: old balance – euros earned – euros spent – new balance.

5. Use of earned euros

The euros of the Auchan Account can be used partially or globally when the holder of the Auchan loyalty card wishes, within the limits of the provisions reproduced below, namely:

  • Euros acquired between 1st January and 31st October of the current year may be used up to 31st January of the following year.
  • Euros acquired between 1st November and 31st December of the current year can be used until 31st January of year N + 2.

In the case euros are not used during the periods mentioned above, the holder of the Auchan card automatically loses the benefit In the case the card is not used by its holder for a continuous period of one year, Auchan reserves the right to delete any personal information relating to this card and to permanently deactivate it.

In the store, at the end of the registration of its items, the card holder Auchan can inform the check out hostess of his wish to use all or part of the accumulated amount on his Auchan account (apparent balance on his last statement of account).

The use of smartphones is allowed to cumulate euros during the various passages to check out but the holder must present his original card for any request to use the accumulated euros on his account.

The euros accumulated on the Auchan Account are neither refundable nor exchangeable in cash. No currency can be returned.

The euros accumulated on the Auchan Account can only be used at the point of sale and/or on partner websites offering this feature.

Any attempted fraud in the acquisition and/or use of the accumulated euros will give rise to immediate cancellation of the order, Auchan reserving the right to sue the fraudster in court.

6. Conditions of the use of the card

The use of the Auchan loyalty card implies the unreserved acceptance of the present general conditions which the subscriber acknowledges to have taken note by completing the card application form filled in store or by subscribing to the loyalty program via the site www.auchan.lu.

The Auchan loyalty card can only be used by its holder. A single customer can only hold and use only one Auchan loyalty card.

The Auchan loyalty card is the property of Auchan Luxembourg and can not be reproduced. It may be withdrawn at any time in case of fraud or any improper use or not in conformity with the provisions of these general conditions of use. The holder of the loyalty card Auchan then loses any right to use the advantages attached to his Auchan Account, the euros acquired not being returned to him.

The offers communicated in catalogues, in stores and / or on the Internet and identified by a sign are exclusively reserved for the holders of the Auchan loyalty card in the context of purchases corresponding to quantities usually acquired by a consumer. Certain promotional activities may include a maximum amount of purchases in order to benefit from the advantages attached to the Auchan loyalty card. In the event of a dispute over the amount in euros acquired or the new accumulation, any complaint must be made to the point of sale and/or the partner website concerned, within the day of purchase corresponding to the ticket concerned. No protest will be accepted after this deadline.

Auchan Luxembourg, the sales outlet and/or the partner website are exempt from any responsibility for any consequence, direct or indirect, of any anomalies in the functioning of the loyalty program, whatever their cause. Thus in the event of an anomaly resulting in particular from an obvious technical or material error or a computer bug in particular with regard to the accumulation of euros of the Auchan Account, the holder of the Auchan loyalty card will not be able to demand or claim for a refund. As soon as this anomaly has been discovered or brought to the knowledge of Auchan Luxembourg, the latter will proceed to the regularization of the Auchan Account. This adjustment will be brought to the knowledge of the holder of the Auchan Account on the tickets issued after this regularization.

In the event of loss or theft of the card, Auchan can not be held responsible for the fraudulent use of the amount credited to the Auchan Account and no request for refund will be admissible.

The holder must inform Auchan Luxembourg by mail of the loss or theft as soon as it occurs. The holder may then request the issuance of a new card. Any loss or theft of the Auchan loyalty card automatically loses any right to use previously acquired advantages, whether vouchers or euros registered to the credit of the Auchan Account. The card can not be transferred outside the home.

7. Evolution of the loyalty programme

All or part of the rules, rights and advantages presented in these General Conditions and/or in any other document relating to this loyalty programme may be modified or deleted temporarily or definitively at any time.

In this case, the rights and benefits acquired by the holder of the Auchan loyalty card at the date of cancellation or modification will remain due.

On the other hand, rights and benefits modified or eliminated in the future will not give rise to any right to compensation in favour of the participant. In this case, holders of the Auchan loyalty card will be notified fifteen (15) days in advance by posting or distribution at the point of sale and/or on the partner websites.

The holder of the Auchan loyalty card can, if he wishes, return his card, recalling his name, first name and address. By this restitution, it renounces the advantages of the programme of fidelity Auchan.

Annex 1: General conditions of Easy Scan functions

1. Provision and registration

Easy Scan is made available free of charge to holders of the qualified Auchan card (surname, first name and email address provided) who request it.

This service allows you to register your purchases yourself during your shopping in your Auchan store and, to optimize your checkout (except possible control of your purchases).

Are not concerned all the articles implying an immediate payment on a dedicated case.

The right to use the Easy Scan service is delivered to the Store Reception Point after making a request to a hostess.

2. Acceptance of the general conditions of use

The use of Easy Scan implies your unreserved acceptance of these general conditions which you became aware of when registering.

3. Usage

You must scan each of the products chosen during your shopping in the Auchan store before your checkout. You retain the option of canceling a product from the list of scanned products by subtracting it and removing it from your cart / basket / shopping bag.

  • When checking out, all of the products taken from the store must have been effectively and validly scanned.
  • You are required to pay for all items in your cart / basket / tote.
  • Any item not recognized by the scanner must be given to the hostess so that she can save it and add it up with the other scanned items
  • Purchase or discount vouchers must be given to the cashier in order to deduct them from purchases upon presentation of the product to which the voucher relates.
  • The scanner records all the items taken from the store. The total amount of purchases is established following the data recorded by the scanner and the manual entry that the hostess could make for certain products.
  • You must then confirm on the screen the completeness and correct entry of all the items in your cart / basket / shopping bag and proceed to payment according to the payment method available at the checkout.

In the event of a breakdown or malfunction found in the scanning device, you are required to report it to the cashier or any person in the Auchan store, in order to avoid any error during scanning.

4. Controls and sanctions

You are informed that random checks can be carried out at any time in order to check the conformity between the scanned products and the products present in your cart / basket / shopping bag.

You cannot object to these controls.

If Auchan were to find a non-scanning of products, access to the service will be terminated and you will be required to pay the actual amount of the purchase.

In case of suspicion of abuse and / or theft, you are obliged to prove your identity.

  • In the event of an inspection demonstrating the absence of product scanning, Auchan cannot be held liable in any way.
  • If Auchan were to find improper use or in the event of voluntary damage to scanners owned by Auchan, you could be held responsible for this act and liable to repair the damage caused to Auchan.

5. Termination

Access to the system can be withdrawn at any time in the event of fraud or use not in accordance with the provisions of these general conditions or the Easy Scan brochures as well as for any cause specific to Auchan.

Anyone who has had their Auchan card withdrawn due to non-compliance with these general conditions will not be able to make a second request. In the event that the subscriber does not use the Easy Scan service for a continuous period of one year, Auchan reserves the right to withdraw the benefit of this service from the subscriber concerned. As a result, you will no longer be able to use this service, nor claim any advantage related to the Easy Scan service. A new access request must then be made under the initial conditions described above in point 1.

You can cancel the subscription to this service at any time. For this purpose, you must notify your decision to the reception point of your Auchan store or by mail to the Auchan store, recalling your surname, first name, address and Auchan card number. By this termination, you renounce the use of Easy Scan. However, it will be possible to reactivate this service later.

6. Service availability

Auchan graciously makes the Easy Scan service and its scanners available to Auchan Card holders. The number of devices is limited, the availability of scanners is not guaranteed. Auchan therefore bears no obligation to supply scanners to subscribers to the service.

Auchan reserves the right to stop the Easy Scan service at any time or punctually in the event of a technical failure. Therefore the subscriber can neither use the device nor claim any advantage or compensation from Auchan. Auchan cannot be held responsible in any way if the Easy Scan subscriber could not benefit from the self-scanning service for technical reasons or for any other reason.

7. Modification of the conditions of use

All or part of the rules, rights and advantages set out in these general conditions, in the brochures and magazines of Auchan Cards may be modified or deleted temporarily or permanently at any time.

8. Liability

Auchan declines all responsibility for any direct or indirect consequences of fraudulent or improper use of the Easy Scan service. The Auchan store is exempt from all liability for any direct or indirect consequence related to possible operating anomalies in the functions of the service, whatever the cause.

9. Protection of personal data

In the context of providing the Easy Scan service, Auchan collects and processes personal data relating to users. 10. Applicable law

These general conditions of use are subject to Luxembourg law, subject to the mandatory provisions of the country of residence from which a consumer can benefit in application of Regulation EU 593/2008 on the law applicable to contractual obligations (Rome I).
